EA faced with class-action lawsuit over Battlefield 3 PS3

Electronic Arts is being hit with a class action lawsuit for reneging on the promise of a free copy of Battlefield 1943 in the PlayStation 3 version of Battlefield 3, as announced by Sony at E3 2011.

The main issue is that not only did EA renege on its offer, but did so in what gamers are calling "bait and switch". The announcement that there would be no Battlefield 1943 came at the last minute, and the announcement itself was a single post on Twitter. Instead, PS3 gamers will be getting early access to premium DLC (that they must pay for, of course.)

The suit accuses of EA having "misled and profited from thousands of their customers by making a promise that they could not, and never intended, to keep". There are plenty of multiplatform customers who chose the PS3 version solely on the basis of the bonus.

It'll be interesting to see if Electronic Arts whips out the "can't class action sue us" EULA clause on the plaintiffs. Stay tuned.

I hope they do bring up their stupid Eula and that some judge rips it apart and shoves it back up at EAs stinking south part of their north heading entity...
I also hope they have to give those gamers their games - as promised. Time for the digital giants to be like all the other complanies, subject to law and the universal truth - the customer is always right (almost )...

Very bad handling of the situation by EA, and one that begs for litigation. The compensation on offer alone displays EA's disinterest in the gamer....only their wallets.
As you say Wolfy, hopefully this will highlight not only the many concerns surrounding EA's Origin, but also similar situations with other companies.
If buyers had bought "MW3" without knowing full well it was a re-skinning of "MW2" that might have been grounds for a court case as well.
"Call of Battlerim", "Modern Skyfield 3"....bah humbug.

Just as I said on the previous EA issue about getting banned on their forums for "e-peen", the EA company reminds me of some digital gaming dictatorship. They think they can do whatever they want whenever they want and get away with it every time. If they banned me, for example, I'd learn how to crack games and I'd devote my free time on cracking EA releases. I never thought that I would say that against any publisher, but really, EA deserves to go down. They're a bunch of e-peens indeed!

Well said Bosnian, just don't post that on the EA Forums. You may get banned for games you don't even own (I know that I own some I don't have, according to EA....weird).

Roderick, my now ex-wife used to play "King's Quest V" with me, probably more so and an old gf played "Baldur's Gate", "Biablo" and "AoE" very competitively...so I'm well aware how lethal gf's of gaming can be. My apologies to yourself, and obviously your much better half (three quarters?).

Now pardon me while I whip out my Lvl 25 M1403....with launcher.

@Bosnian, that would be something I could do as well if it weren't so that they still get press time and piracy is in the long run destroying gaming. However, I would turn my acidic tounge to every consumer right oirganisation in the world, every gaming forum and support small developers instead...

BTW, Skyrim is a good concept, but someone really had a brainfart making up the menues and that spread to the team for quality checking... oh who am I kidding, Bethesdas one and only quality controller is working 2 hours every other yeasr and never two days before nor after weekends and seems reluctant to work on Wednesdays....
No problems still SirR? No problems assigning favourites with quick keys even if you have two of the same item, no land swimming fish, UFO hovering spiders, CTD's etc at all? If not you are very fortunate indeed - hanging out with a lvl 28 assasin ;)
Also, I don't think you would hasve a chance against Hero since the range in Skyrim is less then even Oblivion....

Nope, I don't have any problems whatsoever. The favoites menu actually pauses, so I'm not exactly in a hurry to select that chain lightning spell. No land swimming fish, although I'd LOVE to see some! Hovering spiders, never seen 'em. CTD, happened twice so far and that's pretty much par for the course for most games.

On the range...the range is good enough that I can hit an incoming dragon with a slow-moving ice spike at maybe 100-150 meters. Any further and I couldn't hit him anyway, so who honstly cares? Most fights are up-in-your-face range.

Just got to ask - what graphics card do you use and what details are you playing with?
I have maxed everything on my overclocked 560 TI then lowered the shadows, radial blur, and sky reflections in water.

Currently I'm playing on a laptop using an ATI Mobility Radeon 2600 and getting good performance on medium settings. At home I play somewhat higher, but I can't recall the card. A GeForce 8 series I believe.

Even on medium settings, on my laptop, this game is easily the best-looking game I've ever played. Design and style trumps GPU-melting powere anyday.

Hmm, well then I guess we see things a bit differently - chaning everything to max made me see things a lot further away and I'm too used to the Morrowind mentality I guess ;)
Still, my latest lvl 23 character haven't even been up to the grey beards yet. I blame the blacksmithing for levelling too fast!

You can adjust the fades individually, I moved it up somewhat for actors, so I could see people from longer off.

View distance is most problematic IMO when you got a sidekick. You jump over a rock, and he gets lost. So while I'm waiting for Sven to arrive, he just appears from nowhere to like a few feet away from me as he tries to reach me. Not awfully bad though, but a bit of annoyance there. Though he always finds a way to me. We may be gay. I lost one sidekick when I didn't waited for him. Though I presume he died somewhere along the way, and wasn't actually lost (as if it was a bug).

Btw, sidekicks don't have carrying capacity limit? Don't think I pushed them too far to carry my stuff, but they at least seem to be able to carry unlimited cargo.

You holding on to armor and weapons? I just save dragon stuff so I can build dragon things when I reach the smithing level/perk. Oh well. And I throw those dragon things around towns in the open. No body takes them :) well once when I threw them on the ground, a child came and told me I dropped those things and she got those things all back to me. If she wasn't so cute I would've slain her :p

Back on topic, you "Skyrim" junkies, EA has announced they are releasing "BF 1943" for PS owners. Great...if you own the PS3 vrsion.
As for the rest of us...
Now they just need to give us PC players something to make up for the shocking Beta, turned into an Alpha after the latest patch (that's right, a step backward). Game goes from bad to worse.
Jets and choppers now own the maps as they are virtually invulnerable now (the patch nerfed AA weaponry mand buffed the aircraft). We can thank the constant bitching from the jet jockeys for this.
If anything, it has sadly become just as "BF2" did, where even tanks lived mere minutes with attack choppers raping you constantly, impervious to ground AA fire.

The servers?
1/ Cannot play until 4+ have joined...so no practicing
2/ Well, let's just say that it's a good time to cook and eat dinner while waiting to join a game ("Loading level..." ad infinitum).

Well done Dice, you really don't have a clue any more do you?

Well sorry for the REALLY long OT - but seriously - BF1943 - I didn't believe in it to begin with.. Better they put their efforts in making BF3 working better. Good for the PS3 BF3:ers - but I'm not one of them. I'm just not very found of EA's stunts in general ;)
