Sony settles lawsuit with Kevin Butler actor Jerry Lambert

Sony has settled the breach of contract lawsuit the publisher attacked actor Jerry Lambert with, forcing the actor to never appear in a competitor's advertisement for the next two years.

In addition, Lambert has agreed to inform Sony of any work with a competitor two years after that, giving the publisher the right to assess whether the ad would violate the publisher's right to the Kevin Butler character. Lambert may still portray Butler with Sony's permission.

The lawsuit first came down when Butler appeared as a nameless character in a Bridgestone tires commercial that featured a Wii giveaway. Sony felt that Lambert's appearance in the ad made it seem as if Kevin Butler was endorsing the Nintendo console.

You can't restrict talent with those kind of clauses. Actors/Artists go where the work is now, not the contract. That really died out out in the heyday of MGM,Fox, RKO and Universal, and the "Movie Star" where they WERE contracted but available on loan for a fee.
